| Stream Impact Requirements |
The saga of how state and federal regulatory agencies will value streams proposed to be
impacted using permits issued under the Clean Water Act and the Virginia Water Protection Permit (VWPP) continues to change. Further complications are likely due to national level changes published for comment on March 28, 2006 in the
Federal Register
with a 60-day comment period.

| Clean Water Act Permit Compliance |

The U.S. Army Corps of Engineers has noticed an increase in the number of incidents of
permit noncompliance; and on April 13, 2006, issued a
Public Notice of this
fact and a warning that offenders should expect increased mitigation requirements.

| Bald Eagle Delisting |
Contrary to popular
perception, the Bald Eagle is still on the nation’s list of threatened and endangered species (it was down-listed to threatened since 1995). While President Clinton proposed delisting the Bald Eagle in 1999, the U.S. Fish and Wildlife Service (USFWS) solicited comments and then did not act.

| RPA Expansion Proposed in Stafford County |
|
On April 19, 2006, the Stafford County Planning Commission held a special meeting on ordinance O06-15, “An Ordinance to Amend and Reordain Article IV. Planned Development and Overlay District Regulations, by Creating Section 28-65, Water Resource Protection Overlay District, of the Zoning Ordinance.” This ordinance would establish a new overlay district in Stafford County that would greatly extend the Critical Resource Protection Areas (CRPA) in selected parts of the county, though these areas have not been determined.
