| Enforcement Continues with Environmental Protection Agency (EPA) Involvement |
Reports of EPA engaging SAIC to inspect Northern Virginia construction sites for Virginia Pollutant Discharge Elimination System (VPDES) permits and wetlands permit compliance have been provided by targeted builder/developers.
The only defense is to:
- Make sure you have a VPDES permit for all sites exceeding 1 acre of land disturbance;
- Have a copy of your Storm Water Pollution Prevention Plan (SWPPP) on site with the VPDES permit;
- Perform and document the monitoring requested by both your VPDES permit and your wetlands permits;
- Review your wetlands permits and comply with all notification, monitoring, mitigation and preservation (i.e., record easements/covenants) requirements.
