Enforcement Continues with Environmental Protection Agency (EPA) Involvement

Reports of EPA engaging SAIC to inspect Northern Virginia construction sites for Virginia Pollutant Discharge Elimination System (VPDES) permits and wetlands permit compliance have been provided by targeted builder/developers.

The only defense is to:
  1. Make sure you have a VPDES permit for all sites exceeding 1 acre of land disturbance;
  2. Have a copy of your Storm Water Pollution Prevention Plan (SWPPP) on site with the VPDES permit;
  3. Perform and document the monitoring requested by both your VPDES permit and your wetlands permits;
  4. Review your wetlands permits and comply with all notification, monitoring, mitigation and preservation (i.e., record easements/covenants) requirements.
If you need any further information on this subject as it pertains to your site or project, contact Ian Smith, Mike Rolband, or Mark Headly.
