Corps of Engineers Announces Implementation of a Stream Attribute
Assessment Methodology |

On October 13, 2005, after three years of development, the U.S. Army Corps of Engineers
(COE) Norfolk District Regulatory Branch issued a Public Notice announcing the adoption and
implementation of the Stream Attribute Assessment Methodology (SAAM). Effective November
15, 2005, the COE is implementing the SAAM on an interim basis for use in
evaluating stream impacts and determining the amount of mitigation
required to compensate for unavoidable stream impacts to satisfy the
conditions of a Section 404 permit.

Low Impact Development (LID) Breakfast Seminar |

The Northern Virginia National Association of Industrial and Office Properties (NAIOP) will
present a program on Thursday, December 1, 8:15 A.M. – 9:45 A.M., at the Concourse
Building – Auditorium in Vienna, Virginia, to assist developers, builders,
and others to understand an emerging trend in water quality and
quantity control – Low Impact Development (LID).

Changes Proposed for Fairfax County Adequate Outfall Regulations |
|
|
As those of you who are working on development projects in Fairfax County where the receiving stream is eroding can attest, the current adequate outfall requirements in the Public Facilities Manual (PFM)
present a major source of confusion. Although adequate outfall
requirements have not changed in many years, they have not been
uniformly enforced and interpretations as to what “adequate” means
have been subject to change.

Updates on How Long Jurisdictional Determinations and Nationwide
Permits Remain Valid |
|
On June 14, 2005 a Regulatory Guidance Letter (RGL) (RGL No.
05-02) was issued by the U.S. Army Corps of Engineers (COE) stating that a
Jurisdictional Determination (JD) associated with an issued permit and/or authorization is
now extended to be valid until the expiration date of said permit/authorization.
